GENERAL TERMS AND CONDITIONS
SPORTS PARADISE GMBH
General conditions
Unless expressly agreed otherwise, all transactions between Sports Paradise GmbH and customers are subject to these General Terms and Conditions (GTC).
Sports Paradise GmbH operates a water-sports and snow-sports school, which provides mainly ski and snowboard lessons to adults and children of all ages by means of private and group lessons as well as guiding. This includes in particular services such as giving lessons in the skills and knowledge of snow sports and mountain outdoor activities, without guarantee of a specific learning success, as well as guiding and accompanying in winter snow sports and summer sports. The instructor defines together with the client the steps and the desired success which depends on the client’s previous knowledge and skills.
Booking conditions
The total amount of the agreed service is due during the reservation. In the event of late payment, unpaid bookings are considered a firm, confirmed reservation.
Please inform Sports Paradise GmbH, at leat 48 hours in advance, of any wishes or concerns regarding eating habits, medical prophylaxis, etc. so that the instructor can take the necessary measures.
All prices are indicated in Swiss Francs. For payments in euros or other foreign currencies, the corresponding current exchange rate will be applied.
Sports Paradise GmbH reserves the right to adapt or change prices and specifications at any time. Group lessons are held with a minimum of four participants per skill level. In case of fewer participants, Sports Paradise GmbH reserves the right to combine classes with different skill levels at short notice, or to cancel the lessons. Sports Paradise GmbH reserves the right to modify, change or cancel the program or individual services after the conclusion of the contract and also during the activity, if natural and/or weather conditions or other unforeseen circumstances (greater forces, official measures of safety or other risks) so require.
The cost of lessons does not include personal catering, rental equipment, and transportation costs to/from the mountain (lift pass, taxi or public transport).
Cancellation conditions
Cancellation of firm reservations must be done in writing to sportsparadise2017@gmail.com at least 48 hours before the start of the activity. Otherwise the full rate according to the booking will be charged.
Each lesson or group course that is canceled will be charged in full, regardless of whether it must be ended prematurely.
There is no entitlement to a refund for these reasons:
– lost lesson time due to breakdowns of the cable cars and lifts;
– weather conditions;
– the activity cannot be carried out due to the customer’s delay or no-show;
– the customer starts an activity only after its scheduled start or leaves it before its end;
– the customer does not make use of certain (half) days in case of multi-day bookings (also in case of children’s group lessons).
A refund will only be made in case of accident or illness and upon presentation of a certificate from a local doctor.
Behavioural regulations
Wearing a helmet is compulsory during the course for children under 18, snowpark’s lessons and off-piste
The student must scrupulously follow the instructions received;
The course participant must avoid abrupt maneuvers, jumps, competing with other participants or other movements that are inconsistent with safe skiing or snowboarding behavior;
Additional conditions
The undersigned assumes any liability for damage, injury and/or other consequences to his/her person, third parties and/or property, including damage to the equipment provided by Sports Paradise GmbH, which occurs during the ski, snowboard or telemark course caused by him/her;
The undersigned releases Sports Paradise GmbH, its employees and/or employees and their heirs and/or legal successors from any obligation, liability and/or responsibility for personal injury and/or property damage, with the sole exception of damage that are due to gross negligence or intent according to Art. 1229, Para. 2 ZGB. Sports Paradise GmbH is not liable for accidents during snow sports lessons and competitions.
Insurance (health and accident insurance incl. snow sports accidents etc.) is the responsibility of the participant. It is recommended that customers take out insurance for cancellation costs and repatriation;
The teacher may consider a student unsuitable to participate in the course; the teacher can also exclude a student from the course if he violates the above technical and behavioural rules;
All disputes arising out of or in connection with this statement shall be governed by Swiss law. Place of jurisdiction is St. Moritz.
